ChartSmash Terms of Use

Agreement

These terms govern the ChartSmash website and iOS app operated by Hornets Nest Productions. We ask you to accept these terms and read the privacy policy before continuing into the app. We record the accepted version and date.

For the iOS app, the software license is governed by Apple’s Standard End User License Agreement unless a custom license is provided in the App Store. These terms also describe your use of the ChartSmash service.

Subscriptions, allowances, and cancellation

Sign in with Google or Apple to create your first three successful charts free. This account allowance does not reset when you change devices or sign out, and does not automatically start a paid subscription.

Website subscriptions cost $10 USD per month plus applicable taxes. App Store subscriptions use the local price and currency shown in Apple’s purchase sheet. Check the final price before you pay. Subscriptions renew automatically each month until you cancel. Starting a paid subscription requires your explicit agreement in checkout.

Your plan includes 300 successful analyses per billing month and up to 50 per rolling 24 hours. Unused analyses do not roll over. Pending analyses reserve allowance; failures and cancellations before completion release it. There are no automatic overage charges. One analysis can process at a time per account, with up to two additional analyses pending. Reasonable request and capacity controls also protect the service.

Manage a website subscription through ChartSmash Settings. Manage or cancel an App Store subscription through Apple subscription settings. You retain paid processing access through the end of the period you have paid for. Your saved charts remain available to view, edit, and export after processing access ends.

Your subscription provides access on the website and iOS app when you sign in to the same ChartSmash account; you do not need to purchase it twice. The Apple Account used for payment can have a different email from your ChartSmash sign-in. Use Restore Purchases in the iOS app if an App Store purchase is not showing.

Deleting ChartSmash or your ChartSmash account does not cancel Apple billing. Cancel renewal with Apple separately. Deleting your ChartSmash account cancels a website subscription.

Refunds

For website subscriptions, within seven days of your first successful subscription payment, use “Cancel and refund my first payment” in Settings for a full refund, including tax charged on that payment. This immediately stops your subscription and new analyses. Your saved charts remain available. Your bank may take several days to return the funds.

Cancelling renewal alone does not request a refund. The self-service promise applies to your first payment, once per account, rather than each renewal. After seven days, contact support@chartsmash.com and we will consider your request fairly. This policy does not limit any refund or cancellation rights you have under applicable law.

For App Store purchases, request a refund through Apple. Apple handles those requests under its refund process and applicable law; ChartSmash cannot issue a Stripe refund for an Apple payment. The website’s seven-day self-service refund promise does not apply to App Store purchases.

Thank you to our beta users

Accounts with beta access when we launch receive 60 complimentary days from the launch date, with the same analysis allowances in monthly windows. No card is required, and this access never automatically converts to a paid subscription. We will show your end date and send reminders before it ends. If you deliberately subscribe early through the website, checkout will preserve your remaining complimentary time and clearly show when automatic payments begin. App Store checkout becomes available after complimentary access ends.

Your media and permissions

You retain your rights in media you provide. You grant ChartSmash a limited, temporary license to receive, copy, process, and delete that media only as needed to provide the requested analysis and operate the service.

You may upload or import only audio you own or are otherwise authorized to process. Do not use ChartSmash to infringe copyright, bypass access controls, violate a platform's rules, or break the law.

Generated charts

ChartSmash charts are machine-generated drafts and may contain wrong chords, timing, keys, sections, or other errors. Review a chart before relying on it in rehearsal, recording, performance, teaching, or publication.

ChartSmash does not claim ownership of your edits. Your use or distribution of a chart remains subject to any rights in the underlying composition and recording.

Acceptable use

Do not attack, overload, resell access, share accounts to evade allowances, automate around controls, or distribute malicious or unlawful content. Do not extract, replicate, or distill ChartSmash’s underlying chord-recognition technology, or systematically harvest outputs to train, fine-tune, evaluate, or build a competing automated recognition system without our written permission. This does not restrict ordinary musical use, editing, printing, or sharing of your charts, subject to rights in the underlying music. Any restrictions apply only to the extent permitted by law.

Your chart edits

Your chart edits are saved for your use and are not automatically submitted as model-improvement feedback. Accepting these terms does not authorize retaining source audio for training.

If you choose Send edits as feedback, you allow us to use that submission to improve ChartSmash’s chord, timing, and section recognition, including evaluation and model training. Uploaded audio is included only if you separately select it. Share only audio you have permission to contribute. You retain your rights; this permission does not transfer ownership or authorize generating music. Retention and withdrawal are described in our privacy policy.

Availability and changes

The service may be interrupted, changed, or discontinued. We will notify subscribers in advance of material price or allowance changes, which apply prospectively. You can cancel before they take effect. We will make reasonable efforts to protect stored data, but you should keep your own copy of anything important.

Disclaimer

To the fullest extent permitted by law, the service is provided as available without warranties of accuracy, reliability, fitness for a particular purpose, or uninterrupted operation.

Limitation of liability

To the fullest extent permitted by law, Hornets Nest Productions will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, opportunities, or performance costs arising from the service.
